China’s current civil law does not clear define the system of compensation for mental damages, this legislation vacancy caused many parties in the reality of the legitimate rights and interests are not protected. so the compensation for spirial damages should be incorporated into the scope of damages for breach of contract .at the same time to limited the scope of compensation for mental damages, we also need to strictly limited the range of it.
