立法审议的民主基础及制度完善___以审议民主的视角.pdf

摘 要 摘 要 立法是对社会资源进行重新分配和确立的机制，作为立法活动的灵魂的立法审议更 是立法实践过程中的关键阶段和重要环节。关系着法律文本中的制度设计的民主性、科 学性和操作性，关系着价值利益资源的分配的导向和格局，关系社社会制度体系建构的 结构性和均衡性。 立法审议的本质是民主，而长期以来在实践和理论上基本是立足代议民主来认识和 开展立法审议的。不论是在议员立场还是政党取向上，有其局限性。鉴于代议制度的的 非直接性和代表制度的多级性，以及表决上的简单多数决特点，很难真正体现被代表者 的真正意愿和诉求，因而更广泛的参与是时代和现实的必然要求。 审议民主作为民主深化和发展的重要理论观点和实践类型之一，正是为了回应大众 要求参与的呼声和应对公众对社会决策而出现的，因其所具有的公开性、开放性、交涉 性、论辩性等特点而为诸多学者所青睐，也迎合了公众要求参与的诉求，进而可以提升 政府公共决策的科学性和合理性。 立法审议吸纳审议民主的理念和方法将有助于，广大民众通过参与立法审议中的理 性论辩、利益表达、诉求修正，最后达致共通的认识，借以保障立法的科学性、合理性 以及可操作性，进而提高法的“生命力”。因此立法审议吸纳审议民主的理念是必要的、 也是可行的。我国立法审议实践中存在立法审议过于形式化，民众利益诉求表达不充分 等特点，进而一定程度上影响了立法的质量和实施的成效，因此，我们尝试对于我国立 法审议在吸纳审议民主的基础上对实践的制度和方法提出有关对策和建言。 关键词 审议民主 立法审议 代议制民主 完善 I Abstract Abstract Legislation is the redistribution of social resources and establishment of the mechanism.
