城市规划中公共利益的研究.pdf

摘 要 城市规划工作就是围绕着利益问题进行的，城市规划成为协调社会不同利益的 一种工具，其目标就是要实现公共利益的最大化。然而在城市规划建设中，不少人 高举 “公共利益”的大旗却做着违背公共利益的事情，使得代表公共利益的城市规 划处于劣势的地位，原因之一就是大家眼中公共利益概念的模糊。公共利益是一个 高度抽象的概念，本文从总结政治学与经济学中关于公共利益的概念基础上，说明 了公共利益与个人利益的关系，以及公共利益的范围、层次的区别，并结合城市规 划具体环境，从而得出城市规划中公共利益的一个轮廓性概念。 公共利益是现代城市规划应当首先确立的目标，我们发现西方城市规划发展历 程就是探寻城市规划如何更合理、更公平地界定公众利益的过程。同样，计划与市 场两种体制下公共利益的内容不同，城市规划的作用也不同。本文以此为基础，总 结出了当前城市规划中公共利益的表现形式，包括维护城市发展和建设秩序、提供 公共物品、倡导社会公平、调控外部性。 城市规划代表公共利益，但并不表明城市规划就能够自动实现公共利益。城市 规划中不同利益主体包括地方政府、开发企业主体、社会公众、规划师，他们不但 具有分享城市规划中公共利益的权利和创造公共利益的义务，而且在他们创造和享 受城市物质和非物质环境的过程中，彼此之间利益相互影响。公共利益的准确确定 是一项复杂和困难的任务，通过阿罗不可能定理、博弈论等经济学理论的分析，结 合城市规划工作的具体情况，认为实现城市规划中公共利益的理想方式应该是政府 制定规则，城市规划作为纽带，开发主体与公众博弈。因此，只有建立四类利益主 体间相互制约、相互影响的法律规范和相关政策，推动四者之间良性互动的关系形 成，才能实现城市规划中的公共利益。 关键词：城市规划 公共利益 政治 经济 博弈 I Abstract Urban planning is often performed around the interest of different social group. It ha s become a tool to coordinate different interests, aiming at making all the relevant social groups to get their highest interest. However during the performance of urban planning, there are those who at the name of sustaining public interest, however do something to th e prejudice of public interest, thus urban planning was compromised and degraded .Of c ourse, one of the reasons is that public has a blurred conception of public interest which i s a highly abstract concept. This essay, based on the concept of public interest in terms of politics and in terms of economics, explore the relationship between public interest and personal interest, the b ound and the different level of public interest, also in association with cases in the detain ed urban planning,so get a brief concept of public interest.Public interest is the target that modern urban planning should aim at.
