论我国民间资本借贷的法律规制要点详解.doc

摘 要 近年来，随着社会主义市场经济的不断发展，作为我国传统的融资方式，民间资本借贷已经受到越来越多的关注，并呈现出新的特点。民间资本借贷对发展地方经济，促进中小企业融资有着积极的作用，但我国尚无明确的法律体系对其进行规制，相关行政司法监管机制不完善，政府也未承认民间资本借贷的合法地位。而民间资本借贷的现状和自身存在的严重问题导致金融市场混乱，各种违法犯罪不断出现，严重危害地方经济安全和社会稳定。2012年浙江“吴英案”的终审判决，让国内政府机构和专家学者对民间资本借贷进行了广泛的研究和反思。所以，如何建立和完善民间资本借贷的法律规制体系，成为政府的工作目标和专家学者的研究方向。本文也正是基于这种原因，拟从法律规制民间资本借贷的层面作出粗浅的研究分析，并对如何建立和完善民间资本借贷法律规制体系提出一些具体的建议。 关键词：民间资本借贷；现状原因分析；法律规制 ABSTRACT In recent years, with the continuous development of the socialist market economy, as Chinas traditional mode of financing, private capital borrowing has been more and more attention, and showing the new features. Private capital lending to the development of the local economy, promote SME financing plays a positive role, but our country there is no clear legal system to regulate it, the government does not recognize the legal status of private lending.
