中文摘要 行政复议作为一部介于行政职能部门与行政相对人之间的法律，调整的是日益膨胀的行政权与行政相对人合法权益是否受到行政权侵害之间的法律关系。可见，一旦合法权益受到违法不当的行政行为的侵害，行政相对人可以通过行政复议作出维护。但是，在目前的行政复议制度中，行政复议机关相对独立性不足已成为了行政复议制度中一大不可忽视的问题。在现实中，行政复议机关不但难以在中立、客观、公正的立场上维护相对人的权益，也使行政复议结果的权威性蒙上了一层被质疑的阴影。本文希望通过对行政复议机关相对独立性的不足及其缺陷进行分析，提出加强其相对独立性的必要性，并在借鉴国外行政复议机关独立法律地位的基础上提出加强我国行政复议机关相对独立性的构想。 关键词：行政复议；行政复议机关；相对独立性；不足；加强 Abstract Opens with the administrative reconsideration law, administrative reconsideration mentioned in order to prevent and correct illegal or inappropriate specific administrative ACTS, protect citizens, legal persons and other organizations, safeguard the lawful rights and interests of the administrative organs shall exercise supervision and authority.
