创新农村宅基地使用权流转之对策 刘广林 （商丘师范学院法学院，河南 商丘 476000） [摘要] 因土地资源相对稀缺，合理配置、减少浪费尤为急迫。现行法律对农村宅基地实行有限流转的做法已造成耕地被大 量侵占、土地闲置浪费严重、集体及其成员利益受损等弊端。目前，宅基地使用权流转的 “隐形市场”和许多地方创设的宅基 地使用权流转模式正逐步挣脱法律窠臼的束缚。为适应经济发展的要求及宅基地使用权流转的现实情景，扩大宅基地使用权流 转的主体，放宽宅基地流转方式，建立宅基地使用权有偿、有期使用制度及强化产权管理、严格宅基地取得和特殊情况下的收 回制度，实现土地资源 “物尽其用”等，应是对宅基地使用权流转进行有效应对之主要内容。 [关键词] 产权；宅基地使用权；流转；规制 [中图分类号] F321.1 [文献标识码] A [文章编号] 1002-736X(2012)06-0082-04 RenewingthePoliciesofTransferofUseRightofRuralLandforBuildingHouses Liu Guanglin (Law School, Shangqiu Normal University, Shangqiu, Henan 476000) Abstract:It is urgent to make proper use of land due to the relative rarity of land resource. Provisions of the current law about limited transferring of rural land for building houses have leaded to a lot of drawbacks such as encroaching amount of cultivated land, the grave land idleness, damaging benefits of the collective and its members. At present, the invisible market and patterns of transferring of rural land for building houses formed in some places are getting out of the control of law. In order to fit for requirements of the economic development and the real practice of transferring of rural land for building houses, enlarging subjects of transfer, loosening form of transfer, establishing transfer system of compensated use and term for operation of land, strengthening the management of land ownership, establishing strictly the system of occupying and revoking of transferring of rural land for building houses, realizing “the fullest use”of the land resource shall be contents of properly dealing with transferring of rural land for building houses.
