AbstractRecently,theprivatefinancialmarketrisessuddenlyasanewforce.However,whathidesbehindisthefraudlitigation,whichusesfolkloanasitscamouflage,andisofgreatharmandincreasingcontinuously.Thenewcharacteristicsoffolkloanmakethephenomenonmoresubtle,moredestructive,andpoisondeeperonthejudicialauthorityandthecredibilityofthecourt.Oneisthattheprivatelendersarediversifiedandcomplicated.Fraudlitigation,showingatrendoftrans-regional,beginstoexploittheflawofcourt’sinformationplatformtoavoiditssupervisionandharmthethirdparty.Secondly,duetotheproblemofqualitative,factfindingandlegalapplication,therecognitionoffraudlitigationinfolkloanisobscured;thirdly,aswecansee,thecriminallawforcivilfalsepunishmentisstillinthestageofpreliminarylegislation,ourcurrentadversarylitigationpatternislackofeffectivereviewonself-admission,alongwiththeconceptofgivingprioritytomediationintrialmanagementandthelackofsocialcredit,alltheseaggravatethebreedingandabuseofthefraudlitigationinfolkloan.Thispapermainlybycombiningrealcases,identifytheborrowingfalselitigationstartingwithitscharacteristicsandidentificationpoint.Moreover,thepaperhighlightsthestudyoffraudlitigation’sstructuralmodelinthiscase,andthendialysisitsconstitutiverequirementsandthesubstantivehypocrisyofthesuit’selements,thuspracticingtheempiricalanalysisofthefactthattheborrowingfraudlitigationviolatesprincipleofgoodfaith.Inviewoftheabovecharacteristicsandidentificationpoint,combiningwiththereliefwaysoftheoutsiderobjectsinthecase,thediscussionsfollowswithbuildingcivilprocedureandentityconstructionofthethirdparty,andadditionofacomprehensivereliefmechanismofthecriminalregulation.Thisarticle,closelyconcentratingonthestudyoftherecognitionandreliefofthecase,drawsthefollowingconclusions:Thecharacteristicsoffolkloanfraudlitigationprocedureareshownassubjectdiversificationandrelationshipparticularity,theappearanceoflegitimacyandinternalconcealment,defenseprocessweakeningandmultiplemediation;constitutiverequirementsarecomposedofsubjectiveelement,subjectele
