AbstractThenewly-amendedCivilProcedureLawofthePeople’sRepublicofChinahighlightsandstressesontheprosecutorialsupervisionovercivilprocedureandthecompulsoryexecutionbyadoptingnewinterpretationofthebasicprinciplesanddeepeningandenrichingrelevantspecificsystemsandprocedures.However,confusionanddilemmaontheLawremainwhenitcomestoitsapplicationtocivilprotest,duetothelaw’sinsufficientprovisiononrelevantretrialprocedures,andtothosejudicialinterpretationandinternaldocumentsprovidedseparatelybycourtsandprosecutorialorganswhichareneitheruniformnorscientificnorcomprehensive,coupledwiththeparticularitiesofprosecutorialprotestofcourtcivildecisions.InChina,despitethattheprosecutorialsupervisionsystemovercivilprocedurehasbeenimplementedforover20years,socialsatisfactionandrecognitiononitremainsatlowerlevel.Thissystemisstillfarfrompeople’sexpectationintermsofitsstrength,quality,efficiencyandeffect,andmanyshortcomingsanddefectsareconstantlyrevealedintheprocessofoperation.Thisarticleinthefirstpartofthelegalsystemofcivilprotestsystemreviewofthesystem,thecivilprocuratorialsupervisionprincipleinthelawandthejudicialpracticecausedbytheremainingwastedebateandthepracticalsignificancehascarriedonthepreliminaryanalysisanddiscussion.ThesecondpartfromtheGuangxiZhuangAutonomousRegion,thepeoplescourtfornearlyfouryearsofcivilproteststartingretrialcase,collecttherelevantdata,caseinformation,withtheperspectiveofjudicialpracticeeffect,thecivilprotestsysteminourcountry,thepeoplescourtoftheempiricalanalysisontheoperationalstatusofciviltrial.Thethirdpartfromthemotivationofthepartiesapplyforprocuratorialorgansbycomplicated,longapplicationforretrial,repeatedcomplaintsphenomenonstillexists;Procuratorialorgansabuseofrighttoprotest;Toapplyfortheprotesttimelimits,trialscope,suchaslegaldocumentsservednotclear;Procuratorialorgansinaccordancewiththeauthoritytoobtainevidenceiscontroversial;Procuratorialorganslackoftrialprocedure,etc.,deeplyanalyzesthedifferencesofcivilprotestsystemintheory,legislationonfuzzy,practice
