The thirty-eighth clause in “/law/display.asp?ID=8044amp;DB=1the State Compensation Law of the PRC”and “ /law/display.asp?ID=1650amp;DB=1Interpretation of /law/display.asp?ID=1650amp;DB=1the Supreme Peoples Court on certain issues concerning judicial compensation in civil and /law/display.asp?ID=1650amp;DB=1administrative litigation ”stipulate judicial compensation in /s?wd=civil%20actioncivil action and administrative action. The national compensation in civil execution is an important part of the civil litigation, it accounts very great proportion of criminal judicial compensation in recent years. It refers to the liability of compensation due to illegal exercise of the peoples court authority and its staff in the implementation of civil cases, and the illegal exercise cause damage to legitimate rights and interests of the citizens, artificial person and other organizations. Based on the the basic theory of the national compensation of civil execution, and new problems of the Guangxi court in the implementation of the new state compensation law in this two years, this article puts forward ideas and suggestions in civil enforcement in state compensation. It includes three parts:The first part is the summary of the national compensation of civil execution, covering the elements, scope of compensation, procedure of compensation and survey for these cases of the court in Guangxi.In the second part, based on the new problems of the Guangxi court in the implementation of the new state compensation law, it analyses the problems in the procedure and substantive of the execution of the national compensation, for example, for procedure, relationship between the execution of a program needs to be sorted out, how to deal with omission, first handler function has not yet played, cross examination procedure and the allocation of the burden of proof should be improved, lack of restrictions in appeal deadline; for substantive, how to judge “omission”, how to judge “other circum
