重庆大学硕士学位论文中文摘要 重庆大学硕士学位论文 中文摘要 I I 摘 要 在城乡统筹、建立社会主义和谐社会的背景下，我国的社会主义市场经济与 城乡二元社会体制均发生了巨大的变化。同时，农村宅基地使用权的权利效能也 产生了变化。农民对宅基地使用权的权利的诉求不再局限于对居住权的实现，对 使用宅基地使用权获得资本利润的要求也日益迫切。随着经济发展和农村土地市 场的日益活跃，尤其是宅基地使用权流转的隐形市场普遍存在，揭示了在现有的 法律制度下我国对农村宅基地静态管理模式已经僵化，不符合市场经济发展要求。 关于农存宅基地使用权流转的研究和探讨，也因此成为广大农业理论和实践工作 者关注的热点。 本文剖析了我国现行农村宅基地产权制度的特征，宅基地归集体所有，村民 使用；严格限制宅基地使用权流转。揭示了我国农村宅基地产权制度的局限性。 造成农村土地资源大量闲置，阻碍了统筹城乡的协调发展，形成“非法流转”市场引 发诸多问题。因此，我国现行的农村宅基地产权制度是完全的公有制，与坚持和 完善我国经济基本制度的取向相冲突，集约节约利用土地资源相冲突。调查分析 重庆市永川区宅基地使用权流转状况，总体规模小、流转形式多样、地区差异较 大，存在问题较多流转不规范，交易纠纷多，产权意识混乱，流转比例低。 基于上述分析，本文提出对农村宅基地使用权流转的几点对策与建议：要完 善农村宅基地所有权制度；充分发挥市场驱动力，允许宅基地入市流转；明确界 定宅基地使用权流转范围。相关部门应尽快出台的政策性文件，引导和规范农村 宅基地使用权地流转行为，促进农村宅基地使用权有序流转。 关键词：农村，宅基地，流转，制度 重庆大学硕士学位论文英文摘要 重庆大学硕士学位论文 英文摘要 II II ABSTRACT In the urban and rural areas, Chinese market economy system occur to huge change in order to establish next of a socialist harmonious society, with urban and rural society has undergone changes. At the same time, the rights of rural land use right performance also produced changes. Farmers appeal to the land use right no longer limited to the realization of the right of residence, but also contain the land use right of capital profits, because of increasingly urgent demands.
