摘 要 摘 要 随着中国经济的快速发展，在中国各地进行着大量的城市房屋拆迁活动，各种纠纷 不断涌现，也出现了很多拆迁人进行镇压和被拆迁人反抗的各式各样的暴力事件。这表 明在拆迁活动中存在着各种各样的矛盾。其中，以拆迁人和被拆迁人之间的矛盾为主要 矛盾。无论是政府作为拆迁人还是开发商作为拆迁人，都有可能因为拆迁中的矛盾得不 到解决而侵害被拆迁人的合法权益。在现实生活中，被拆迁人合法权益得不到有效保障 的情况时有发生。笔者从基本的拆迁概念入手，分析被拆迁人权益得不到保障原因，并 指出被拆迁人权益保护的立法现状。之后又列举和借鉴了国外关于公共利益和征收补偿 机制的相关规定。最后笔者从公共利益界定、补偿机制、商业征收制度、听证程序及司 法救济方面提出了建议。希望被拆迁人权益保护制度能够得到更好的完善，也希望这些 制度在实践中能够得到体现。 总之，对城市房屋拆迁制度的细致分析，有助于更好的定位被拆迁人在整个房屋拆 迁活动中的角色，对更好的保护被拆迁人具有基础性意义。 关键词 城市房屋拆迁 被拆迁人 权益保护 Abstract Abstract With Chinas rapid economic development, a large number of urban housing demolition activities and all kinds of disputes have appeared all over China.In the process of demolition, there are many kinds of violence about residents who were suppressed and against the demolition.This indicates that there exist various contradictions in demolition activities.The contradiction between the demolition and relocation of people is the main.Whether the government or developers as the demolition, the demolition of the legitimate rights and interests may not be guaranteed because of the conflicts.In real life,the demolition of the legitimate rights and interests can not be guaranteed from time to time. Starting with the basic conception ,the author analyzed the reasons why the demolition of the legitimate rights and interests could not be guaranteed,and pointed out that the legislation present situation in protecting the demolition of the rights and interests.And then listed and learned the research about the public interest and the compensation mechanism of foreign.Finally,the author gives the advice on the definition of public interest, the compensation mechanism, the commercial collection system, the hearing procedures and the judicial relief. The author hope that system of protecting the rights and interests of the demolition can be just perfect, also hope that these systems can be realized in practice. In a word,the careful analysis to the city housing relocation system can be helpful to be better to position
