公共利益、降低风险四个具体目标;并创新性地提出法律约束下的政府主导加行 业自律监管模式。其次从完善现有法律法规、颁布房地产股权投资基金管理办法、 设立房地产私募股权投资基金主体制度等方面提出了法律完善建议。再次从确立 政府监管主体,合理划分监管职权,设定监管标准,建立房地产私募股权投资者 保障制度等方面提出了加强政府监督管理的措施。最后从设立行业协会,颁布行 业协会行为规范和行为指引,建立行业协会配套服务体系三方面提出行业自律的 完善建议,还从信息披露进一步进行了阐述。 关键词:房地产私募股权投资基金;监管理论;制度构建 Abstract Real estate private equity funds in the form of private equity to raise funds, by means of equity investment funds into real estate industry. It still did not get its legal status in our country, and also regulatory concept behind, few and not good academic research. For the rapid development of real estate private equity funds in our country, risk even more, poses a potential threat to the real estate industry and the stability of the financial system This article is based on the background, and summarized the concept, legal nature and history knowledge of Chinas private equity investment fund of real estate and the supervision. Draw on the experience of the advantages and disadvantages of the foreign supervision of the private equity real estate investment fund, analysis the present situation and problem of Chinas real estate private equity investment funds; propose the basic theory and specific regulatory suggestions of supervision of the private equity real estate investment fund. Besides the introduction and conclusion, the main part is divided into the following four parts. The first part, introduce the general theory of real estate private equity investment fund and its supervision. This part firstly introductions the concept, characteristics, significance of the real estate private equity funds. With compare illegal financing, real estate private equity securities investment funds, real estate investment trusts, defined its legal nature as financial intermediary companies. Then combing the history of the real estate private equity funds development and the current development status in our country.
