贵州大学硕士研究生学位 HYPERLINK \l _bookmark63 主要参考文献..............................................................................................................48 反不正当竞争视角下的商标权保护 中文摘要 商标权保护与市场竞争之间存在着紧密关系，商标权保护是一种保护合法竞 争、促进有效竞争以及在此基础之上的制止不正当竞争和维护市场竞争秩序的利 益平衡机制。然而，随着市场竞争的加剧，商标不正当竞争行为层出不穷，不仅 仅局限于《商标法》和《反不正当竞争法》中规定的行为，还有多种表现形式， 这体现出现行商标法律制度对商标权保护的不足。无论是现行商标法还是传统的 商标法理论,对商标权的保护都存在着明显的缺陷，要完善商标权的保护，除了 商标法的规范，还应当借助反不正当竞争法律制度来进行。反不正当竞争法可以 实现商标法无法企及的保护未注册商标的利益，解决商标的权利冲突等，对商标 权保护具有特殊意义。在知识经济条件下，围绕商标的占有、使用的竞争将会越 来越激烈，为了使真正意义上的商标权获得完善的保护，促进市场竞争秩序的良 性发展，应当立足于全面完善反不正当竞争法律制度、构建科学的民事责任体系 以及建立有效的法律监督机制。 关键词：商标权 商标权保护 商标法 不正当竞争 反不正当竞争法 Trademark Rights Protection under the View of Anti-unfair Competition Abstract Trade market rights linked closely with competition of market. Trademark legislation revealed in the protection of legal competitions and the promotion of effective competitions as well as the prohibition illegal competitions and the sustenance of marketing competition order. However, as the increasing fierce situation of market, various kinds of illegitimate competition behaviors beyond the regulation of Trademark Law and Anti-unfair Competition Law having been came into being, which reveal the weak points of the current trademark protection system. Thus we should perfect the additional protection of the trademark rights of anti-unfair competition law which has indispensable supplementary function for protecting the trade mark right, especially for protection of non-register trademark, solve conflicts among trademark rights etc. Therefore, under the background of intellectual economy, the competitions of trademark rights will extremely hot. In order to strength the further protection of trademark rights, we should on the basis of revising and perfecting anti-unfair competition acts and regulations of existing trademark rights progressively, which safeguard the fair competition order of the trademark rights conscientiously.
