摘要 “FA”规则是反倾销和反补贴调查中被诉企业不应诉或消极应诉时面临的 首要规则之一，该规则主要应被用以防止反倾销调查中受调查的出口商拒绝或 不在合理期间提供所要求的数据，或者严重阻碍调查。与此同时，WTO《反倾销 协定》及其附件２对反倾销调查主管机关使用 FA 规则也设置了程序上和条件上 的限制，但另一方面，在反倾销调查主管当局享有缺乏严格而明确约束的自由 裁量权的情况下，该规则也极可能被用来作为推行贸易保护政策的工具。我国 作为世界上重要的贸易大国，对反倾销和反补贴法律中的 FA 规则的研究就显得 尤为重要。我国的出口企业在遭到外国反倾销调查时，应注意积极应诉、“尽最 大努力”及时、准确地提交调查问卷所要求的信息，避免主管当局采用“最佳 可获得信息”，并在外国（地区）反倾销调查主管当局滥用“最佳可获得信息” 情况下，谋求我国政府进行交涉或将争端提交 WTO 争端解决机构解决。 【关键词】“FA”规则 反倾销 反补贴 出口 Abstract FA rule is anti-dumping and countervailing investigation or being sued respondent enterprises do not face the negative appearance of one of the primary rules, the rules should be used primarily to prevent the anti-dumping investigations exporters under investigation or not to refuse a reasonable period of to provide the requested data, or seriously hamper the investigation.
