To realize the sustainable development of the economy, the protection of the environment is essential to be taken seriously. Environmental Impact Assessment (EIA)，with the core of public participation, based on the modality design and legal effect arrangement of the public participation in the statute law, plays an important role in the conservation of environment. The current Environmental Impact Assessment Public Participation (EIAPP) has attained plenty of legislative progress in the years of practices whereas there are still some defects of this institution. The problems includes limited scopes of the EIAPP in the planning and project, the ambiguous of public participation in the environmental considering of policy and the lack of alternative solution institution.
