. .. 摘要 房地产交易中霸王条款简单的说是经营者为了逃避法定义务、减免自身责任而单方面提出不公平的合同条款。其主要表现形式有：开发商单方提供填写本应由双方协商的合同条款，强制要求买房人接受；开发商就有关特定事项单方面拟定补充协议，要求购房人必须签订；买受人要求对其权益的有关事项作具体约定时，开发商不予配合。而产生这种现象的原因是多方面的，包括经营单位的逐利性，垄断形成的强势地位，信息不对称和缺乏性选择。房地产交易中霸王条款的现象不是只有我国存在，国外也存在着相同的情况。国外放低长交易中霸王条款的规制以行政为主导的监管模式，以行政手段矫正普遍性的不公平条款，司法作为行政手段的后盾和个体救济的途径，同时充分利用消费者团体和社会公众的监督和舆论作用。我国通过对国外相关情况分析后，总结了规制霸王条款应从立法规制、司法规制、行政规制和行业协会自律及其他社会团体的规制这几个方面着手。所以我国现行对房地产交易中霸王条款规制做了分析，主要缺陷有立法控制的缺乏，司法控制的混乱，行政控制的倾斜和社团控制乏力乏术。并且通过立法规制，司法规制，行政规制，社会规制以及综合规制来完善房地产交易中的霸王条款规制制度，以促进我国房地产市场的发展。 关键字：霸王条款，公平性，规制房地产交易 Abstract Real estate transactions in the clause of Xiang Yu the conqueror is simply the operator in order to escape legal obligation, responsibility and relief of unilaterally presented the unfair contract terms.
