论自然资源综合立法1

摘要：当下的自然资源立法，主要应适宜规范对象的综合性特征，形成一个结构科学合理、
内容充实完备、效力层次分明的法制体系，保障人与自然协调发展。自然资源部的角色设定，
是具有所有、管理和监督多重职能的部门，资产性管理和资源性管理都需要重视。自然资
源综合管理，包括央地协同、府际协同、部门协同、官民协同等多层次、多向度的协
同机制。应推动以合理利用为原则、权责明确、处罚严厉的统一的自然资源法立法。应从
理念原则、法律体系、立法模式、基本制度方面进行自然资源统一立法创新。

To Discuss Comprehensive Legislation of Natural Resources

Abstract: The current natural resource legislation should be suitable for the comprehensive
characteristics of the regulating object, and form a legal system with scientific and reasonable
structure, complete content and clear effect structures to ensure the coordinated development of
people and nature. The role of the Ministry of Natural Resources is to have multiple functions of
ownership, managing and supervising, therefore, asset management and resource management
need to be taken seriously. Comprehensive management of natural resources includes multi-level
and multi-directional coordination mechanisms such as central government coordination,
inter-governmental coordination, departmental collaboration, government-civilian collaboration,
etc. So we should promote the unified natural resources legislation based on the principle of
rational utilization, well defined power and responsibility as well as severe punishment. The
