摘 摘 要 代位求偿权作为海上保险中的一项基本法律制度，无论在司法界还是在理论 界，一直是争论的热点问题，并且两者对于如何阐述代位求偿权的有关规定存在着 诸多的差异：而《海商法》、《保险法》、《海事诉讼特别程序法》以及其他相关法 律对保险代位求偿权的相关规定均未能给人明确的答案。我国的《海商法》，虽然 一定程度上借鉴《1906年英国海上保险法》中的作法；但可能是因国情的差异， 两国关于海上保险代位求偿权的很多规定相差甚远，尤其代位求偿权的行使名义。 鉴于此，本文以保险代位求偿权的行使为立足点，试图通过对比中英两国关 于代位求偿权制度的相关法律规定，结合理论和实践，较为全面和深入地分析了 海上保险代位求偿权的相关法律问题。并且通过对理论的阐述以及对案例的分析， 对一些较有争议的问题提出自己的观点，以期对有关法律规定的不足之处提出一 些建设性的意见。 关键词：海上保险代位求偿权行使名义范围海商法保险法海事诉讼 特别程序法1906年英国海上保险法 ABSTRACTThe ABSTRACT The doctrine of subrogation is one of the basic stipulations in marine insurance， so it is always the focus both in judicature and theory，and there is also much disagreement between the both two mentioned above．However，the stipulations in Marine Code，Insurance Code，Special Procedure Law in Marine Litigation and other correlative of the People’Republic of China are not perfect and fail to give us a clear answer-In a way,the stipulations in Marine Law referred to those in Manne Insurance Act 190but according to the differences between the two countries，the material stipulations about the doclrine of subrogation are different from those in Manne Insurance Act 790especially in whose name to execute the subrogation of underwriters， Therefore．this article starts off from the execution of subrogation．and tries to studies the doctrine of subrogation by comparing the stipulations in Chinese law with those in British law．Then the article studies and analyses some questions related to subrogation all-sided，by combining theory with practice．Besides，in order to put forward some suggestions to amend the stipulations of subrogation， the article discusses some disputed questions about subrogation，through illuminating the theory and analyzing the relevant cases． Key words：marine insurance，subrogation，execute／execution，the name， extent，Maritime Law．Insurance LawSpecial Procedure Law in Marine Litigation，Manne Insurance Act 1 906． V 引 引 言 代位求偿权是海上保险中的一项基本的法律制度，是一项古老而独具特色的制 度，也是海上保险中最重要、最复杂的领域之一，长久以来一直是专家学者探讨的 课题。“代位求偿权”，这一概念最早源于罗马法，我国是从西方法律中引进
