第34卷第1期 第34卷第1期 南京林业大学学报(自然科学版) V01．34．No．1 2010年1月 Journal of Nanjing Forestry University(Natural Science Edition) Jan．，2010 hnp：／／www．nldxb．com 盗伐、滥伐林木材积测算及定案研究 张民侠，余光辉+ (南京林业大学森林资源与环境学院，江苏 南京210037) 摘要：盗伐、滥伐林木材积数量是对案件定性、对行为人处罚的重要依据。目前材积测算的方法 较多，相关法律法规对测算方法没有统一规定，导致同一案件出现多个测算结果。笔者采用案例 研究、调查访问、模拟现场调查等方法，根据涉案林木的状态，分别对几种常用的测算方法的精度 进行了比较研究，提出应根据不同案情确定材积测算方法；同一案情有多种测算方法时，应优先 选用精度较高的方法，使测算结果具有唯一性，并经司法机关认可取得合法性。这样对盗伐、滥 伐林木案件进行定案时可减少争议的出现，缩短办案时间，提高办理毁林案件的质量。 关键词：盗伐、滥伐林木；立木蓄积；材积测算；定罪量刑 中图分类号：S757 文献标志码：A 文章编号：1000—2006(2010)01—0085—06 Study on estimation of tree volumes and final decision for deforestation and illegal felling of forests ZHANG Min—xia，SHE Guang-hui’ (College of Forest Resources and Environment，Nanjing Forestry University，Nanjing 210037，China) Abstract：The number of timber volume involved in illegal logging and deforestation is important basis for de- termining the of law and penalties for the perpetrators．At present，there many methods of volume mess· urement．And there is any unified provisions of relevant laws and regulations the calculation methods，which suit in number of measurement results in case．In this paper，several methods such studies，investigation， and simulation employed according the timber involved in the case．Comparative study is also used concerning the accuracy of several commonly used methods of measuring．Volume measurement methods should be deter- mined according different cases．Preference should be given the hiish precision method when there several mess- urement methods used in case．Only in this way，the results of the measurement be recognized by the judicial organ be unique and legitimate．Such cases of illegal logging and deforestation reduce the emergence of the dispute， the time of handling and improve the quality of handling of forest cases． Key words：deforestation and illegal felling of forests；stumpage cumulation；estimation of volume；conviction and sentencing 目前对盗伐、滥伐林木案件的定性、对涉案人 破坏森林资源刑事案件具体应用法律若
