建设工程挂靠问题研究 内容摘要 随着我国经济的快速发展，建筑业的发展已经成为拉动国民经济增长的重要力量。建筑行业的市场竞争不断加剧，建筑企业在建设施工等各环节所涉及的法律风险问题也日益增多。在建筑施工各领域中所暴露出来的“挂靠”、“转包”、“违法分包”等现象，严重破坏了我国建筑市场的正常秩序。虽然我国《建筑法》、《合同法》及《建设工程质量管理条例》等法律法规对于建设工程中的挂靠问题都有相应的规制，但是在具体实践中却成效欠佳。在诉讼案件中，讼争的当事人、律师、法官等对于挂靠的概念也存在不同认识和理解，往往导致案件处理结果大相径庭。笔者在本文中通过对建筑市场较为常见的挂靠类型入手，分析现行立法对于挂靠行为规制的不足，并提出相应的立法完善措施及可行性建议。 关键词：建设工程；挂靠；资质；规制 Abstract With the rapid development of our economy, the development of the construction industry has become an important force driving the growth of the national economy. The construction industry market competition unceasingly intensifies, the legal risks of construction enterprises involved in all links of construction are increasing. In the construction of each field of the exposed the call, sub, subcontracting phenomenon, has seriously damaged the normal order of the construction market of our country. Although Chinas construction law, contract law and construction quality management regulations and other laws and regulations for the construction project in the linked problems have corresponding regulation, but in practice it unsatisfactory effect. In the litigation, litigation parties, lawyers, judges and so on also has the different understanding and the understanding to the concept of link it often leads to the outcome of the case, be quite different. The author in this paper based on the building market linked to the most common types of analysis of the current legislation, insufficient regarding the dependence of regulation, and puts forward the improvement measures and the corresponding feasible suggestions of legislation.
