PAGE PAGE 3 THE RESEARCH OF LAWYERS INVOLVED IN CRIMINAL RECONCILIATION SYSTEM ABSTRACT To be an important exploration of criminal penalty system, criminal reconciliation play a significant role in terms of quelling of the hostility between victim and suspect and promoting harmony and stability of the society. In these years, many china national judicial organizations have begun to try criminal reconciliation in some areas and have formulate relative operating rules. some problems have apparent from the judicatory practice all over china. To resolve the problems above, I hold the view that the focus should be laid on the design of system. However, the lawyer’s role in criminal reconciliation should be given prominence to in the system-designing. This article emphatically expound the interior cause of lawyer’s intervention in criminal reconciliation from the lawsuit mode of “ victims to be the center ”and lawyer’s compulsory attorney system . From outstanding problems occurred in the current practice of criminal reconciliation(manifestation are:1.public power intervene too much while the autonomy of the parties cannot reach the level of enough;2.the operations of procedure come to be non-standard;3.the implements of criminal reconciliation are baffled by the reality of suspects’ being held in custody) ,this article selective analysis the importance to the reality of lawyer’s intervention in criminal reconciliation and the special function in criminal reconciliation.
