汪丽：离婚损害赔偿制度研究中文摘要 汪丽：离婚损害赔偿制度研究 中文摘要 离婚损害赔偿制度是现行婚姻法中的重要制度，其不仅完善了我国婚姻法的立 法体例，而且赋予了当事人寻求救济的法律依据，适应了新形势下调整婚姻关系新 情况的需要，是我国婚姻家庭立法史上的重大突破。但该法律条款的高度抽象化和 过于简单化，给实践操作带来了许多困难。鉴于此，本文从离婚损害赔偿制度的基 本理论入手，介绍评析了离婚损害赔偿责任的性质和功能，对离婚损害赔偿制度的 立法模式进行了比较研究，论述了我国离婚损害赔偿制度的构建等内容，重点探讨 了离婚损害赔偿制度存在的问题及完善措施。在适用范围存在局限，损害赔偿请求 权主体仅限于夫妻之间，离婚损害赔偿标准不一，离婚损害赔偿案件举证困难等问 题进行理论探讨和现实分析的前提下，提出了扩大损害赔偿适用情形、放宽主体限 制、明确赔偿标准、确立证明标准等进一步完善我国离婚损害赔偿制度的浅见，以 期对该制度的完善和发展有所裨益。 关键词：离婚损害赔偿立法完善 AbstractThe Abstract The divorce damage compensation system，which not only improves the style of China’S Marriage Law of legislation，but also gives the legal basis to the parties for seeking relief,it adapt to the new situation and adjust the marital relationship needs of the new circumstances，it is one of the most important systems in the existing marriage law and it makes a major breakthrough in the history of marriage and family legJ【slation in China．However,the highly abstract and simplistic legal items have brought many difficulties to the practical operation．In view of the fact，this article starts with the basic theory of the system of compensation for divorce damages，introduces the nature and functions of the divorce damage compensation liability,conducts a comparative study of divorce damage compensation system’S model legislation，discusses such contents as the construction on the system of compensation for divorce damage，etc。have probed into the system existing problems of compensation for divorce damage and perfection measure especially．The limitations on the scope of application，the main claim for damages is limited to between husband and wife，dix,orce damage compensate standard is uneven，and the divorce damage compensate case presents evidence questions such as theoretical and practical analysis of the premise，humble opinions are put forward to further improve our system of compensation for divorce damages，such as expanding damages apply to cases，relaxing restrictions on the main body,clearing the standard of compensation，est
