Assessment task instructions
Candidates will be given one closed-book exercise consisting of three case studies
for the assessment of Outcome 1. This exercise should take candidates no longer
than two hours to complete. The case studies, without the questions attached, can
be given to candidates 7-10 days before the assessment takes place. Candidates will
be allowed to bring to the assessment a copy of the case study and two sides of an
A4 sheet of paper with relevant notes. This material must be submitted with the
candidate’s answer.
Textbooks and class handouts will not be permitted. The assessment may be
completed in one sitting with a maximum total duration of two hours. Supervision
of the assessment and any relevant reassessment should take place.

Case Study 1
Maggie McGlumpha bought a tumble dryer in a sale from Thunderbolt
Lightning, an electrical retail store in Inverness. The store was selling the appliance
for the very reasonable price of £250. About two months later, when Maggie was
using the dryer, a latent defect in the wiring of the appliance caused it to short
circuit with the result that it caught fire. The combination of flames and thick black
smoke belching out of the dryer completely destroyed Maggie’s new fitted kitchen
— not to mention the clothes which were in the dryer at the time. Luckily, Maggie
had popped down to the shops when the incident occurred and she was unhurt.
Question 1
Is Maggie entitled to bring a legal action against Thunderbolt Lightning for
selling her a defective tumble dryer and will it matter that she purchased the goods
in a sale?
Maggie’s son Charlie, who was visiting from Australia, was not as lucky as his
mum. He was in the house having a nap on the sitting room couch. Charlie was
later taken to hospital and diagnosed as suffering from serious smoke inhalat
