PAGE II PAGE I 摘要 2008年1月1日颁布实施的《中华人民共和国劳动合同法》以下简称《劳动合同法》，对于促进中国经济的发展，维护农民工的合法权益，调动农民工的积极性，提高用人单位的经济效益，具有十分重要的意义。然而，《劳动合同法》在实施过程中，仍然存在着一些侵害农民工合法权益的现象：农民工工资偏低、被拖欠现象严重、劳动时间过长、安全生产条件差、缺乏社会保障、职业病和工伤事故多等。这些问题引发了不少社会矛盾和纠纷。解决好这些问题，直接关系到维护社会公平正义，建设社会主义新农村，构建社会主义和谐社会的重大战略问题。 本文针对《劳动合同法》存在的问题进行分析研究，并提出解决问题的建议，力求为完善《劳动合同法》，维护农民工的合法权益提供参考。 关键词：劳动合同法；农民工；问题；国外经验；对策 Defects and improve the Labor Contract Law to protect the interests of migrant workers Abstract January 1, 2008 promulgation of the Labor Contract Law of the Peoples Republic of China is hereinafter referred to as the Labor Contract Law, to promote the development of Chinas economy, safeguard the legitimate rights and interests of migrant workers, to mobilize the enthusiasm of the migrant workers, to Improve the economic benefits of the employer, has a very important significance. In this paper, the problems of the Labor Contract Law analysis, recommendations and propose solutions to problems, and strive to safeguard the legitimate rights and interests of migrant workers in order to improve the Labor Contract Law, a reference.
