- - PAGE # - 论宋朝法律制度的主要变化 摘要 宋朝是中国封建社会发展的一个新的时期，其经济、政治、文化、科 技等方面，都比前朝有长足的发展和显著的变化。而作为“表明和记载经 济关系要求”和统治者“用来实现经济利益手段”的法律，在宋代亦表现 出与其经济、政治、文化相适应的时代特色，表现在法律制度上的立法、 诉讼和审判均较前代呈现出新的特点，深深地打上了时代的烙印，并对后 世的法律制度产生了重要影响，完善和丰富了中华法系。叶适曾说： “今 内外上下，一事之小，一罪之微，皆先有法以待之。 ”足见宋朝法网之密 和对法治的重视 。 本文首先从宋代主要法律文献入手从整体上把握宋代的 立法情况，然后分别从刑事、民事、行政、司法等方面研究宋朝法律的变 化及特点，最后谈谈自己的看法。 关键词 《 宋刑统》；宋朝；法律制度；司法制度 Introspection of State Owned Shares Reduction Abstract Song dynasty was the development of Chinas feudal society, a new era, its economic, political, cultural, science and technology, than the former have made great progress and significant changes.
