论跨国公司环境法律责任承担-毕业论文.doc

华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  跨国公司在对全球环境的恶化进程中扮演着越来越显著的角色，使得对跨国公司 环境法律责任的研究显得尤为必要。本文主要从跨国公司与环境法律责任的界定与关 系入手，指出跨国公司环境法律责任与内国公司环境法律责任的最大区别就在于责任 的跨国性，同时指出跨国公司环境法律责任并不等同于跨国公司的环境法律责任，二 者是包含与被包含关系，这也是本文探讨跨国公司环境法律责任承担及实现的依据所 在。基于这种包含关系的考虑，笔者创造性地提出因跨国公司自身所造成的环境损害， 其法律责任的承担主体不能只限定在跨国公司单一主体上，而应向责任主体多元化发 展，即分别探讨跨国公司母公司、跨国公司母国与东道国政府作为责任承担主体的必 要性和可行性。正是这种全方位、多角度地寻求责任的承担主体，才能更好地维护受 害人的利益，实现法律的公平与公正，同时也更能唤起并调动全民、全社会环境保护 意识。 然而一切有关责任的追究与探讨，其最终目标是为了责任的实现，故笔者在文中 也对跨国公司环境法律责任的实现方式和实现途径作了尝试性的分析与研究，提出多 种救济手段的综合运用才是责任实现的最佳途径。最后，本文对我国目前有关跨国公 司环境法律责任的法律制度以及国际法制的相关法律制度提出思考和建议，希望对应 对该种责任有所帮助，最终实现全球环境保护。  关键词：跨国公司  环境法律责任  承担  实现  I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract Multinational corporations play more and more important role in global environment worsening. It’s very necessary to study legal liability undertaking of multinational corporations in environment. Based on discussing the definition and relationship between multinational corporations and legal liability in environment, the article considers that the transnational legal liability in environment is the biggest difference between legal liability of multinational corporations and legal liability of the company in country. At the same time, the legal liability of multinational corporations in environment is different from the multinational corporation’s environmental legal liability. The former includes the latter. This distinction is very important for the article to discuss the legal liability undertaking of multinational corporations in environment. Based on this kind of inclusion relationship, the article points out creatively that the legal liability of multinational corporations in environment should be undertaken by not only multinational corporation subsidiary company, but also multinational corporations parent company, multinational corporation’s mother country and the host country. Seeking for the responsibility main body from different angles, it’s good for the benefit of the victims. It can realize justice and fair
