民事检察和解的正当性及制度完善 中文摘要 民事检察和解的正当性及制度完善 中文摘要 民事检察和解是检察机关民事行政检察部门近年来在实践中不断探索创新而形 成的申诉案件当事人达成和解协议，检察机关民事行政检察部门终止审查的一种结案 方式。它突破了我国民事申诉案件抗诉和不抗诉两种处理结果的格局。它在节约司法 资源、维护司法公正、维护社会稳定等方面起到了重要作用。现实中该项制度还面临 理论基础薄弱、认识尚未统一、操作不甚规范、缺乏有力保障等困惑。 民事检察和解制度的产生和发展，其正当性来源有四个方面：我国古代调解制度 及儒家“和”文化是其历史基础；私法自治原则是其法理基础；检察监督职能衍生是 其权力基础；民事检察和解符合纠纷多元化解决的价值理念。它有着类似于法院执行 和解的法律效力。本文通过对民事检察和解进行程序设计、制度完善，以期获得法律 保障，使之在法律和制度的框架下良好、科学地发展。 关键词：民事检察和解 理论基础 法律效力 制度完善 作 者：方 静 指导教师：张永泉 I 英文摘要 民事检察和解的正当性及制度完善 The Legitimacy of the Civil Procuratorial Reconciliation and Perfection of the System Civil procuratorial reconciliation is a closing cases method formed by procuratorial organs of the civil administrative procuratorial department with relentless exploration and innovation in practice which the parties reach a settlement and the procuratorial organs of the civil administrative procuratorial department terminate examination. The method breaches out the two patterns of dealing cases results—appeal or not appeal. It also plays an important role in the saving of judicial sources, guarantee of judicial justice and safeguard of social stability. But in reality, the system of dealing cases has a weak theoretical basis, not unified thinking and lacks orderly operation and sound security. The formal origin of civil procuratorial reconciliation has four branches with the reconciliation system in ancient China and harmonious culture of Confucianism as the historical basis, the autonomy of private law as legal foundation,
