A b s tra ct: C om paredw ith other k inds of property, w orks of art are often valuable and irreplaceable resources, and usually contain
public interest. A eneral principle lex situs is applied to determ in e the ow nersh ip of tran snational sto len art. M oreover
the rule of lmi itation is crucial to solve such disputes. Now there h ave been m any countries to con cern more about the
interestbalancin amon the ori inal own er, the ood faith purch aser and public policy in le islation and practice. Som e
authors have recomm ended to develop th e traditional prin ciple of lex situsw ith them ost si n ificant contact, that is to say,
to determ ine th e ow nersh ip of stolen artw ith conflicts rules of substantive elem ents.
