March, 2003 South Dakota Department of Transportation Storm Water Management Program This document contains the South Dakota Department of Transportation’s (SDDOT) Storm Water Management Program (SWMP) as it applies to its many miles of right-of-way and roads, rest areas, weigh stations and other properties throughout ten defined urbanized areas within the State of South Dakota. In 1987, Congress amended the Clean Water Act (CWA) to require implementation, in two phases, of a comprehensive national program for addressing storm water discharges. The first phase of the program, commonly referred to as “Phase I” was promulgated on November 16, 1990, (55 FR 47990). Phase I in 40 CFR Parts 9, 122, 123, and 124 requires National Pollutant Discharge Elimination System (NPDES) permits for storm water discharge from a large number of priority sources including municipal separate storm sewer systems (MS4s) generally serving populations of 100,000 or more and several categories of industrial activity, including construction sites that disturb five or more acres of land. The SDDOT was issued a joint Phase I permit with the City of Sioux Falls effective November 1, 1999. The permit expiration is September 30, 2004. Phase II, which is the second phase of the storm water program, expands the existing program to include discharges of storm water from smaller municipalities (10,000 population or above) in urbanized areas and from construction sites that disturb more than one acre of land. The Storm Water Phase II Rule extends coverage of the NPDES storm water management program to certain “small” MS4s but takes a slightly different approach to how the storm water management program is developed and implemented. A small MS4 is any MS4 not already covered by the Phase I program as a medium or large MS4.
