论法定继承人范围与顺序的立法完善 内容摘要 论法定继承人范围与顺序的立法完善 内容摘要 法定继承制度是继承法中较为重要的制度，其中法定继承人的范围与顺序尤为重 要。但我国现行《继承法》施行以来，随着社会经济的发展，其立法背景发生了很大 的变化，《继承法》关于法定继承人范围与顺序的规定也日益显现出不合时宜之处， 因此有必要对这部分规定进行修改完善。本文通过比较分析主要大陆法系、英美法系 国家相关立法例及我国的继承历史，再结合我国学者的立法建议稿，提出完善建议： 第一继承顺序是被继承人的子女及其晚辈直系血亲；第二顺序法定继承人是被继承人 的父母；第三顺序法定继承人是被继承人的兄弟姐妹及其子女；第四顺序继承人是被 继承人的其他直系血亲尊亲属及其他三代以内旁系血亲亲属。配偶则是无固定顺序继 承人，可以与任一顺序的血亲继承人以不同的应继份共同继承遗产。 关键词：法定继承 范围与顺序 立法完善 作 者：许 芬 指导教师：史浩明 I Abstract On the legislation perfection of the range and order of the legal heirs On the legislation perfection of the range and order of the legal heirs Abstract Legal succession system is an important part of succession system ，the range and order of the legal heirs is even more important. Since the Inheritance Law performed, our economic has developed quickly. So the legislative background of the Inheritance Law has changed greatly. The regulation of the range and order of the legal heirs in the Inheritance Law is not adapted to the society. So it’s time to perfect this part of the Inheritance Law. This paper is to put forward some suggestions by using comparative analysis approach and positive method. This paper compared the similar regulations of main civil law countries and common law system countries and analyzed the inherited customs of our people. The suggestions of this paper also combined with related regulations of the Suggestion Drafts written by researchers.
