华 中 科 技 大 学 硕 士 学 位 论 文  摘  要  “媒体审判”是一种新闻报道干预、影响审判独立和司法公正的现象，表现在 媒体报道司法的现实中，它超越正常的法律程序抢先对案情作出判断，对嫌疑人作 出定性、定罪、定量刑以及胜诉或败诉等结论，形成“预设审判”；它引用片面、夸 张以至失实的案件事实，运用感性、煽情旨在刺激公众爱憎情绪的报道语言，造成 “情感审判”；它把持民众言论自由、批评建议、知情表达等崇高权利，却是标榜惩 恶扬善、新闻自由而塑造众议民愤、公意合流，造成“民众审判”，其“审判”实质 只能是以新闻自由干预司法独立，用道德裁判取消司法审判，借媒体的“话语强权” 代替舆论监督司法，这对于建构和谐有序的民主法治社会，有着极大的负面影响。 与此同时，“媒体审判”跨越新闻与司法两个学术领域，涉及新闻报道与司法实 践、关系新闻自由与司法独立、联接新闻监督与司法公正，是协调传媒与司法敏感 关系、调控新闻与法制动态平衡的切入点和突破口，又颇具学术和现实意义。 本文立足于国内外有关“传媒与司法”关系的研究，背倚新闻学、传播学、法 学、政治学等学科资源，从“媒体审判”的原初涵义出发，剖析其概念，释例其表 现，通过内涵辩义、学科探源、现实解读等手段试图对“媒体审判”的现象予以正 视。鉴于其关键作用，在考察有关成熟规则的基础上，结合我国特殊实际，笔者拟 就“媒体审判”的规避和防范提出了一些建议和意见。 关键词：媒体审判；新闻监督；审判独立；司法公正；新闻自由；舆论监督 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract “Media trial” is the phenomenon in which news coverage intervenes the independence and justice of jurisdiction, in the reality of news reports on jurisdictions, “media trial”performances like, it goes beyond the normal proceedings of judicial then makes judgments on the merits of the case, the characterizations of the convict, and gives conclusion as win or fail, which we call it a “default judgment”; It quotes the biased, exaggerated and inaccurate facts of the case, uses the emotional, sensational language as to stimulate the public’s sentiments, causing an “emotional trial”; It controls people’s rights of expression, criticism and suggestion, but it prevents the freedom of news and shapes the popular views with anger, creating an “opinion justice”. The real of “media trial”is that, freedom of the press interfere with the independence of judicial, the way of moral justice replaces the procedures of jurisdiction, it uses the “words of power”of media to instead the supervisio n of media. In a word, it manufactures great negative impacts on building a democracy, harmonious and orderly society.
