“红帽子”企业的财产权问题研究 摘要：本文以温州“鹿运事件”为例，从法律的视角剖析了“红帽子”企业产权中普遍存在的四个问题：企业产权的性质，企业产权的量化，政府干预私有产权的界线和私有产权的法律保护。在对这些问题逐一解答后，笔者得出结论：对“红帽子”企业产权问题的真正解决必须依赖于行政法治的进一步发展，从事前防范和事后救济两个方面入手对私有产权进行保护。事前防范应建立产权界定协商机制和政府干预制约机制；事后救济应走行政诉讼及行政赔偿的道路。 关键词：“红帽子”企业财产权法律救济行政法治 Title:Studyonthepropertyrightsof“redcap”enterprise Abstract:Citing“Lu-yuncase”inillustration,thisarticleexploresonfourbasicissuesthatexistinthepropertyrightsof“redcap”enterprise:theownerofthepropertyrights,thequantizationofthepropertyrights,theboundaryofgovernmentalpowertolimittheprivatepropertyrights,andthewaystoprotecttheprivatepropertyrights.Aft
