技术性贸易壁垒对我国农产品对外 贸易的影响及对策 摘 要 关键词： On the Impact and Countermeasures of TBT to Agricultural Products Foreign Trade of Our Country Abstract The role of tariff barrier and traditional non-tariff barrier in the international trade is declining. As a type of non-tariff barrier, technical barriers to trade are using as an important way of trade protectionism and are becoming an important issue in economic field. As the biggest developing country and the third trading country, the development of trade in our country is suffering the restrict of TBT, TBT has become the first non-tariff barrier which restricting our country. This paper, based on introducing the meaning of Technical Barriers to Trade, form the background, consequents and features of Technical Barriers to Trade, make a whole consequent to Technical Barrier to Trade and the causes that China′s agricultural products encounter technical trade barriers and the impact on agricultural products were analyzed from the current situation, and corresponding countermeasures to cope with foreign technical trade barriers were put forward, which has reference for the development of export trade for China′ s agricultural products and the improvement of the competitiveness of China′ s agricultural products in future. 1 前 言1.1 本研究的目的与意义 1.2 国内外研究文献综述 1.2.1 国内研究文献综述 国内对技术性贸易壁垒的研究开始于20世纪90年代。 叶柏林、陈志田（1992）从标准化角度分析了技术性贸易壁垒问题，对标准守则的形成、技术性贸易壁垒的概念与基本内容作了框架性的分析。 高文书（2003）指出，如果进口国为实现保护国家安全、保护环境、保护居民健康等合法目标，并按照WTO规则要求实施技术性贸易壁垒措施而给国际贸易造成障碍时，则构成合法的技术性贸易壁垒；如果进口国以合法目标为借口，有意并违背有关WTO规则要求实施技术性贸易措施而给贸易造成障碍时，则构成非法的技术性贸易壁垒，如果由于贸易各方的体制性差异或经济技术水平差距而给贸易造成障碍时，则称之为客观性技术性贸易壁垒。 叶柏林（2001）、李志军（2002）、张锡嘏（2004）、张海东（2004）等分别阐述了美国、日本、欧盟等主要发达国家的技术性贸易壁垒体系。 王孝存、刘厚俊（2003）通过对国外的技术性贸易壁垒仔细分析，提出了我国应对国外技术性贸易壁垒的政策建议。 宋宇（2003）对韩国、日本、英国、美国和欧盟等国家技术性贸易壁垒中的非政府行为进行了比较而言，并且指出了其中非政府行为存在的优点，建议我们应充分利用非政府行为来构筑我国的技术性贸易壁垒。 张荣鼎（1995）认为，技术性贸易壁垒是把双刃剑，一方面可以提高商品质量，保护消费者利益；另一方面又容易被用来作为贸易保护主义的有力手段。 冯宗宪、柯大纲（2001）认为，从技术性贸易壁垒的作用机制看，一方面，技术性贸易壁垒具有控制进口商品数量的作用，即只有符合某些技
