惩罚性赔偿制度研究 作者姓名：冯玲 专业班级：法学2003090203 指导老师：××× 摘 要：惩罚性赔偿制度从本质上而言，是一种将原本属于刑事法律的惩罚、威慑功能溶入民事法律中的民事责任形式，是英美法上的一项重要制度。近年来，该制度对我国在内的大陆法系国家的损害赔偿理论及立法产生了重大影响。现行法律中的补偿性赔偿、精神损害赔偿、罚金、罚款不能替代惩罚性赔偿。但是，惩罚性赔偿在我国存在适用范围、适用条件、赔偿数额等问题。尽管如此，我国确实存在建立惩罚性赔偿制度的必要性和可行性，并且需要在侵权行为法、合同法领域中建立健全惩罚性赔偿制度。 关键词：惩罚性赔偿 损害赔偿理论 侵权 违约  On the Punitive Damages System Abstract: In essence, the punitive damages system, one of the civil liabilities in civil law that embraces both the punitive and deterrent functions by the criminal law in the past, is now an important system under the common law family.
