PAGE 14 论未成年人犯罪的责任分化 学生：，政法学院2007级法学专业 指导老师：，政法学院 摘要 本文集中探讨了与未成年人犯罪有关问题，将把重点放在对于未成年人犯罪的处理，即对需要对未成年人成长负责的群体和个人的责任进行分化。最终希望社会、学校以及家长都可以明确自己在对未成年人的成长中所应尽的责任。 刑事责任本身具有法律上的实体意义，要实现刑事责任处罚已然之罪以及预防未然之罪的目标，就要使抽象的刑事责任转化为具体的活动，也就是说必须使刑事责任转化为具体的措施和制度。 我们需要建立一个制度来明确学校和家长以及社会在预防阻止未成年人犯罪问题中所要承担的责任，如果他们没有尽到自己的义务，则需承担相应的后果，也就是分析其在未成年人犯罪问题中没有履行哪些义务，从而采取一定的处罚措施。 关键词 未成年人犯罪；责任承担；责任分化 Abstract The paper focuses on the problems about minor crime,we suggest that all of us should help the people who under-aged and we should help them further. Well pay more attention on the differentiation of responsibility society, schools and parents,we can define their responsibility more clear about minor crime. Well analyse the responsibilities of each class in minor crime problems.We need to take measures to prevent this problems. We used to focus on the punishment to control and prevent minor crime, but this is not the helpful way to solve the essence of the problem. We need to create a system to exact the obligations of schools, parents and society in the prevention of stopping minor crime problem.We will assume their responsibilities and if they dont do your obligation, theyll be required to bear the corresponding consequences. Nowadays, we should put the causes of minors crime to a very serious position to discuss.We should observe the whole social environment, seeking the rigorous scientific feasible methods and perfect system to face this problem, solve the problem.So how do we prevent minor crime, how to deal with minor crime,that is what we need to focus on, this problem is going to be a essential part of contribution the harmonious society . This paper will also referring foreign in dealing with these issues some measures are taken and system, and put forward some feasible methods.
