In China, the traditional theory of civil law, the punitive damages has been consistently ignored. In fact, the compensatory damages with the closely related, complementary to a civil legal system, with its comprehensive compensation for the victims loss, punishing and preventing illegal acts such as multiple functions, more and more on the science of civil law legal systems of compensation for damages in particular areas of research and practice have a positive impact. This article from the system of punitive damages in China legislative background, the statutory conditions as well as in the practice problems and so on, but also on the current Chinese punitive damages system and puts forward some specific suggestions, let the judicial system to combine the current situation of our country play its effectiveness, reduce illegal infringement behavior, promote our country healthy and orderly development of socialist system.
