学科分类号 0301 本 科 毕 业 论 文 题 目（中文）： 论票据利益返还请求权 （英文）：Discussion on The Right of Claim for Restitution Interests 姓 名 陈敏 学 号 2006050226 院 （系） 法学院 专业、年级 法学专业 2006级 指导教师 喻名峰 二○一○年 月  [摘要] 票据利益返还请求权制度作为票据权利消灭后的补救措施，其目的在于寻求一个平衡点，以期既发挥票据功能，又避免债权人受到不合理的损失。本文以分析、比较的方法对票据利益返还请求权制度的价值、成立要件进行阐述，而对于此票据利益返还请求权制度的性质，除德国票据法将其界定为不当得利返还请求权之外，各国立法均未予以明确，学界对此也是众说纷纭。本文就各种学说进行分析、比较。从法律效果的角度得出结论。通过与其他各国及地区的票据法的相关规定作比较分析，指出我国现行规定的缺陷并提出完善的建议。 [关键词]：利益返还请求权；平衡；不当得利 Abstract: The right of claim for restitution interests is one remedy way of extinction of the rights on a negotiable instrument. It tries to search a balance between the parties, so that it can make good use of negotiable instruments and avoid unreasonable loss of the creditors. In this paper, the value and the conditions of claim for repayment of the interests are interpreting by comparative analysis. Except the Germanic negotiable instruments law determines the nature of claim for reinstating interests, the other state does not give the specific answer. It makes the scholar offer all kinds of nature .This article will analyze all kinds of theory of the claim for repayment of interests and get the nature by aspect of the Legal effect .also, the disadvantages in Chinese Commercial Instrument Law are pointed out and revising advice is put forward.
