摘 要 近年来，改革开放的深入和市场经济的发展不仅改变了人们的经济生活，而且在新生事物的不断冲击下，人们对道德以及法律的看法也在飞速的变化着，对婚姻的态度也由原来对婚姻的忠诚变为对婚姻的戏谑或者叫低度忠诚。人们婚姻家庭观念的改变对社会生活产生了广泛、深远的影响，离婚案件呈逐渐增多的趋势，因此讨论离婚的法定条件以及其改进方案让其更符合人们现代观念,使其符合逐渐变化的社会环境是有很大必要的。 本文从离婚的法定条件的立法思想以及立法原则入手，通过对婚姻的产生和发展的研究，分析出婚姻其实就是合同形式的婚姻，并就现行婚姻法的感情破裂主义等几个关键因素分析，探讨感情破裂主义在司法操作上存在的诸多问题，笔者建议将感情破裂换为夫妻关系破裂或许会更好，同时，发现我国现行婚姻法关于军婚的规定，剥夺了非军婚方的婚姻自由的基本原则，应当废除对军婚的特殊保护，还发现现行的离婚诉讼调解制度，是一个强制性的程序，没有给予离婚当事人一个自由选择的过程，应当借鉴美国的相关法律，将其调整为可以自由选择的一个程序。最后，对上述各个部分进行总结，给出完善建议。 我国的婚姻法只有不断的修改，才能适应发展迅速的社会生活，才能更好的保护公民的婚姻相关的权益。 关键词： 婚姻法； 离婚； 法定条件；完善建议 ? ?
