辽宁省渤海大学 毕业论文（设计） 题 目： 防卫限度问题研究 专 业： 法学 年 级： 2015年 学 生： 杨艳 指导教师： 完成日期：2016 年 10月 20 日 摘要 正当防卫是指为了使国家、公共利益、本人或者他人的人身、财产和其他权利免受正在进行的不法侵害，而对不法侵害者实施的制止其不法侵害且未明显超过必要限度的行为。而防卫明显超过必要限度造成重大损害则构成防卫过当。基于此，对防卫限度问题研究也就显得十分必要，本人以一法学本科毕业生的角色，浅谈对防卫限度的理解和研究。 我个人认为正当防卫理论体系中争议最大的莫过于其限度问题，1997年刑法修订也将正当防卫限度作为其核心。所以正当防卫的防卫限度也一直是正当防卫制度的核心问题，它既是正当防卫正当性的重要条件，也是正当防卫与防卫过当的分界线。还有关于防卫限度的学说很多，“损害说”最为合理，防卫过当具有主客观方面的基本特征。无限防卫是普通的正当防卫的一种特定表现形式，将无限防卫权称之为特殊防卫看似更合适一些。它与普通的正当防卫既存在着联系，也存在着区别。无限防卫权的表述模糊亟待完善。 关键词： 防卫限度，防卫过当，无限防卫权 Abstract Justifiable defense refers to the state and public interests, the person himself or others, property and other rights from being infringed, and the implementation of the suppression of unlawful infringement and not obviously exceeds the limits of necessity behavior on unlawful infringement.
