建筑作品定义之重构 摘 要 我国《著作权法实施条例》将“建筑作品”定义为“以建筑物或者构筑物形式表现的有审美意义的作品”。这一定义存在着建筑作品的形式仅限于“建筑物”和“构筑物”、未明确建筑物的内部设计以及标准设计元素能否成为建筑作品著作权的保护对象等缺陷，由此往往会导致司法认定上的困惑，同时也将损害权利人的经济利益。我国立法应当将“建筑作品”的定义重构为“以任何有形表达形式表现的有审美意义的内外建筑设计，包括但不限于建筑物、构筑物、建筑设计图和建筑模型，不包括标准设计元素。”并且在相关释义中明确：“建筑设计图”包括建筑草图、建筑方案设计图和建筑施工图；“建筑模型”包括建筑物落成前的施工模型与建筑物落成后的缩影模型。 [关键词] 建筑作品 定义 形式 内部设计 标准设计元素 On Redefinition of Architectural Works Abstract Architectural works are defined as “aesthetic works, which are, and can be, expressed in architectural or constructional form” in the Implementing Regulations of the Copyright Law of the Peoples Republic of China. However, there are three defects of this definition. First, architectural works can only be expressed in architectural or constructional form. Second, the definition does not state whether the interior design of buildings can be protected as architectural works or not. Third, the definition does not state whether the standard elements in the design can be protected as architectural works or not. The three defects are likely to cause difficulties in judicial determination. In addition, they will jeopardize the interests of the related people. Therefore, “architectural works” should be defined as “the exterior or interior design of a building as embodied in any tangible form of expression, including but not limited to buildings in architectural or constructional form, architectural drawings and architectural models, but excluding standard elements in the design.” Moreover, it should be noted that architectural drawings include architectural sketches, architectural plans and architectural working drawings and that architectural models include models for buildings and models of buildings.
