摘 要 法学教育的基本目的，在于使法律人能够认识法律，具有法律思维、解决争议的能力。法学专业学生接受的精英式教育，其目的是成为法律人，而法律人的核心要素是具备法律思维。法律思维不仅对法科学生职业有重要影响，而且将对我国法治建设及法律职业共同群体产生基础性的作用。法律人在法治社会进程中担当先锋重任，法律思维方式则是法治社会的必然要求。法律思维与其他思维相比有其特殊的定义、内容?、形式，在法治社会建设进程中，法学本科生法律思维的养成对传统法学教育提出了更多要求，传统法学教育其固有的弊端正面临挑战。 本文分析了何谓法律思维及其如何培养，将法治理念的培养、课堂教育的改革、法律信仰的重塑以及国外先进教学模式呈现出来，试图寻求适合我国法治建设所需要的法律思维模式。希望本文能引起法学学生对法律思维养成的重视并对其所帮助，同时希冀对法学教育能有所裨益。 关键词：法律人 法律思维 诊所法律教育 法律思维的养成 ABSTRACT The basic purpose of legal education is to make the layer to raise awareness about the law, with legal thinking, the ability to resolve disputes. Legal science specialized student accept the elite type education, its purpose is to become layer, whos key elements is have legal thinking. Layer assume the heavy responsibility of pioneers in the process of building the rule of law, and legal thinking mode is the inevitable requirement of the society ruled by law. Compared with other thinking, legal thinking has its own special definition, content, form, in the process of building the rule of law, in the process of building the rule of law, he legal thinking training for the law undergraduate made more demands of traditional legal education, the traditional legal education have being challenged for the inherent drawbacks. This paper analyzes the meaning of legal thinking and how to train it, present the rule of law training, classroom education reform, the law of faith, and advanced teaching mode remodeling, and trying to find the rule of law necessary for our legal thinking.
