摘 要 1840 年的鸦片战争是中国近代史的开始，西方列强用坚船利炮打开古老中国封 闭的大门，给中国人民带来了深深的伤害，但同时，也给中国带来了新的思想和文 化，中西文化的交流与碰撞自此展开。清末的“礼法之争”便是这一背景下的产物， 它是中国近代社会变革的一个部分，对近现代中国法制文明的发展产生了深远的影 响。 第一章介绍了清末“礼法之争”中礼教派及法理派的代表人物，并对“礼法之 争”的始末做一阐述； 第二章就“礼法之争”的焦点以及主要论题作出分析，阐述礼法之争的核心所 在； 第三章以《大清新刑律》为个案，介绍西方先进法律精神的引进以及中国传统 法律文化的保留； 第四章对“礼法之争”发生原因及意义作一分析。同时，本章还总结了中日法 律移植出现不同结果的原因，从而可以从中吸取清末修律失败的教训，学习日本法 律移植成功的经验，为我国法律制度现代化寻求正确的方法。 关键词：礼法之争；法理派；礼教派；清末修律；法律移植 I Abstract The Opium War in 1840 is the beginning of the modern history of China, Western powers used gunboats to open the closed doors of the ancient Chinese, brought deeply hurt to the Chinese people, but at the same time, also brought to China new thoughts and culture, communication and collision between Chinese and western cultures since commenced. The “Late Qing ritual law dispute” is a product of this context, it is a part of the social change in modern China, and has a profound influence on the development of the modern Chinese legal civilization. The first chapter begins with a brief introduction of the main representatives of the “Confucianism” and “de jure school of the late Qing Dynasty ritual law dispute，and illustrates the whole story of the battle of ritual law. The second chapter analysises the focus and the main topics of the ritual law dispute, then elaborates the core of the ritual law dispute. The third chapter cite the “Fresh Criminal” as a case to present the introduction of advanced western legal spirit and the reservation of chinese traditional legal culture. The fourth chapter makes an analysis of the cause and significance of the ritual law dispute, and sums up the problems in the late Qing legal transplantation.Then on this basis to seek the successful transformation meth
