论伦理原则在民事立法及司法中的应用 摘 要 伦理是基于道德的价值取向和原则规范。研究法律与伦理的关系，需要把法律看为一种社会现象，把伦理看作是一种价值标准和价值依据。法律的产生以一定的伦理精神为观念先导，这决定了法律的伦理价值内涵：凡是法律禁止和制裁的行为，都是伦理所反对和谴责的行为；凡是法律要求和肯定的行为，都是伦理所提倡和颂扬的行为。因此，法律的善恶优劣是根据伦理精神标准评判的，法律应当接受伦理的评判，伦理原则促进法律规范的合理化和法律行为的正当化。我国在传统上比较重视伦理原则在日常生活上的作用发挥，到现在伦理原则对我国的民法仍然产生了重要的影响，有许多表现。在民事立法与司法上，也深深被烙上了伦理的记号。本文首先从伦理原则的基本概论着手，在该部分，分析其含义以及内容；在本文的第二部分，具体分析伦理原则，分别举出其在民事人格、克隆人的法律地位来说明伦理原则在我国民法上的立法体现，以及对我国司法实践上的影响；第三部分，详述伦理原则对我国社会主义法治建设的积极意义；最后，提出我国的法学教育要重视法律伦理教育的观点，并提出具体的办法。 关键词：伦理原则；民事；立法；司法 Abstract Ethics is based on moral value orientation and principles of norms.
