摘 要 银行业作为现在经济的核心，在一国的经济体系中占据主导地位，因此银行业的健康运行是一国经济的关键，而它的监管对银行业的正常运作起着至关重要的作用。现在的银行面对着外资银行的冲击，传统的银行产业面临着信息化，技术化，网络化的巨大变革，与此同时，我国传统银行潜在的金融风险也逐渐显露出来，这一切给我国银行的监管带来了巨大挑战。 本文从我国商业银行监管现状分析入手，进而发现我国银行监管的问题，指出我国在监管基础薄弱，法律法规建设不足等方面的问题，再利用对比的研究方法，通过借鉴发达国家的银行监管经验提出完善我国商业银行监管的建议。 关键词： 银行监管；银行职能；监管体制；监管对策 Abstract Banking is the core of the economy now, dominant in a countrys economic system, therefore the health of the banking operation is the key to a countrys economy, and its regulation in the banking sector plays a crucial role in normal operation. Keywords： regulatory bank；regulatory functions ；Regulatory regime 目 录 一、 前言 商业银行监管是商业银行监督管理的简称，是指金融监督管理机构依照本国法律对银行进行监管。银行业是一国经济的核心，良好的监管是银行业安全和稳健运行的基本条件。随着各国银行金融监管的放宽以及金融自由化进程的加快，银行业发展也迅速加快，银行产品层出不穷，竞争日益激烈，伴随而来的银行经营风险也已巨大规模冲击着传统银行：1994年墨西哥金融危机、1995年巴林银行的倒闭、大和银行的毁灭以及太平洋银行的倒闭等危机事件都引起了国际的广泛关注。因此，加强银行监管以及防范化解金融风险等问题已被各国政府及银行监管当局所普遍关注。面对新形势，各国在加强研究新型银行监管的同时，调整原先的银行监管体系，进一步提高监管安全程度及效力。商业银行为了壮大自己业务的同时也进行积极的创新，这一方面既提高了银行业绩也方便了人民群众，同时又对监管当局的监管能力带来的巨大的挑战。监管当局面对复杂的国内外形势，如何把监管任务做好，这是值得重视的问题。我国银行监管虽然取得了良好成绩，但同时也有许多不足，也要与时俱进，在学习外国先进监管经验的同时，也要根据本国实际情况来完善我国监管。 二、我国银行监管的历史回顾与监管现状 2.1我国银行监管的
