农村宅基地使用权流转法律制度研究 摘要：我国现行法律规定农村宅基地使用权不能流转与农民出售及转让农村宅基地使用权的普遍现实形成了明显的利益冲突。因此，改革现行立法，解禁农村宅基地使用权流转，对于提高农村宅基地利用率，实现农民融资手段，促进城乡人口流动，改变城乡二元结构，构建和谐社会具有十分重要的意义。允许农村宅基地使用权的流转不仅有其现实的意义而且符合农村宅基地作为一种用益物权属性的需要。因此，从各方面完善现行的农村宅基地流转的法律制度以符合社会发展的需要是关系到中国九亿农民切身利益的大事。 关键词：农村宅基地；使用权；流转； On the homestead legal issues Abstract: Existing legal provisions in land use right transfer and the farmers can not sell and transfer land use right of the universal reality of the formation of a clear conflict of interest.
