上海市房屋标准租赁合同 SHANGHAI TENANCY AGREEMENT (合同编号: ) (CONTRACT NUMBER: ) 出租方(甲方):Land Lord(Part A): 承租方(乙方):Tenant(Part B): 居住人: Resident: 根据《中华人民共和国合同法》、《上海市房屋租赁条例》(以下简称):《条例》的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法出租的商品房事宜,订立本合同。 In compliance with ((The Contract Law of the People’s Republic of China)) and (( Shanghai Tenancy Agreement)) (herein as Agreement), this Agreement is made, through consultation on the basis of equality, voluntaries and mutual benefit, by and between Party A and Party B, whereby Party A agrees to let the legally possessed real estate to Party B and Party B agrees to take the same from Party A on the following terms and conditions. 出租或预租房屋情况 The Situation of Leasing or pre-leasing Premises. 甲方 出租 (出租/预租)给乙方的房屋坐落在 (以下简称该房屋)。该房屋用途为 住宅 ,房屋类型为 公寓 、结构为 钢混 。甲方已向乙方出示: Party A shall let to Party B: , which is the legal possession of Party A (hereinafter referred to as ‘the Premises’). The Premises use is Residence, the type of the Premises is Apartment, and the structure is Reinforced Concrete. Party A shall show to Party B the following item: 【出租】房地产权证『证书编号: 』。 The certificate of real estate ownership, the registered number is 甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 设定抵押。 Party A shall set up Tenancy Agreement with Party B as the ownership rights to realty (1.ownership rights to realty 2.bailee 3. other rights to realty by the law of the Premises). Party A shall notify Party B the premise is mortgaged before signing the Tenancy Agreement. 该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。 The usage area, condition, requirement of common space or share occupancy of the Premises, condition of facilities, the associated amenities required by Party B based on the agreement of Party A shall be specified in the Supplementary Provisions to this Agreement by the parties hereto.
