权利思维下大学生性教育【摘 要】 本文以为，大学生性教育的重心应是以引导与培养责任意识与责任精神的性行为规则教育，而从权利思维出发对大学生开展性教育更有利于大学生群体负责地处理性关系与对待性活动。私法自治下性权利规则的运行--性权利的自治（自律）以及自治责任的承担（他律）从主体内外两个方面培养与强化了当事人的责任意识与责任精神。此外，从权利思维下大学生性教育的理念出发，文章也谈到了大学生性教育中理性精神的引导与强调、性健康与性隐私保护、贞操与性爱婚姻教育等问题的现实启示。 【关键词】 性权利； 私法自治; 大学生性教育； 责任意识与责任精神 Analysis of college students sexual education from the angle of personal rights MO Aixin Graduate School, China Univerisity of Political Science and Law, Beijing 102249, China 【Abstract】This article has presented the focus of the college students’ sexual education, which should be education on rules of the students’ sexual intercourses and activities with strong sense of responsibility. Besides, the college students will benefit more from such directional sexual education based on the protection of personal rights, and consequently tackle with the sexual intercourses and the sexual activities more responsibly and prudently.To be specific, such directional sexual education should be operated under the consideration of the rules of Private autonomy on sexual rights, which could be summarized as two main aspects- the exercise of sexual rights (autonomy) and the accountability of sexual commitments (heteronomy) . Thus, the rules would contribute to the cultivation and the development of colleges’ responsibility consciousness internally and externally. Along with this trait, this article also covers various relating aspects, such as the introduction and the emphasis of the rational belief in the college students’ sexual education, the protection of sexual health and private sexual rights, the education on the chastity and marriage based on love and so on. 【Key words】 personal sexual rights； private autonomy； college students’ sexual education； responsibility sense 就人生的“性福”而言，严格说来，人的一生都离不开性教育。潘光旦先生认为，“性的教育原应包括性与个人关系的全部。所谓全部，至少可以分做三部分，一是性与个人，二是性与社会，三是性与种族。”[1]伴随着人类性文明的进步，在性与个人的全部关系中，人类性教育内容亦可谓丰富翔实，既包括有性科学知识与性观念的教育，亦有性伦理道德与性法律的教育。本文以为，性教育的这些内容在不同的人生阶段是有着不同侧重的，从学校教育来看，大体说来，中小学生的性教育一般应是
