研究与探讨 Research and Approach 我国核电监管的法律规制研究 罗永魁 （中国核能电力股份有限公司，北京100045 ） 摘要：为满足电力需求和应对气候变化，我国确定了安全高效发展核电方针，颁布实施核电发 展规划，提出了核电发展目标。目前我国已经制定了一系列核电安全法规，但核电监管立法尚不能 满足核电产业规模发展的需要。在分析我国核电监管立法存在的问题并参考借鉴国外经验基础上， 从有效规范核电监管、保障公众安全健康的角度，探讨制定我国核电监管法的可行性和必要性。重 点从起草我国核电监管法、改革和理顺核电监管体制、明确核电发展规划的法律地位、制定厂址资 源保护与开发利用制度、规范核电市场竞争行为、建立核损害民事责任制度等方面，提出建立和完 善我国核电监管法的立法建议，以期为我国核电安全高效发展保驾护航。 核电 监管 制度 安全 关键词： ； ； ； D922.292 A 1003-2355-(2015)03-0022-05 中图分类号：   文献标识码： 文章编号： Doi: 10.3969/j.issn.1003-2355.2015.03.004 Abstract: In order to meet electricity demand and deal with the climate change, China made its policy of developing nuclear power in a safe and efficient way, also it implements the nuclear power development plan and proposes the nuclear power development goals. At present, China has developed a series of nuclear safety regulations, but the nuclear regulatory legislation still does not meet the needs of the nuclear power industry. On the basis of analyzing the problems in nuclear regulatory legislation and learn from other countries, this paper explores the feasibility and necessity of developing China s nuclear regulatory law in perspective of effective regulating and public ’ safety. The paper gives legislative proposals of establishing and improving China s nuclear regulatory law from aspects ’ of drafting of the law, reforming and rationalizing the nuclear regulatory system, making clear the legal status of nuclear power development plan, developing site resource protection and exploitation system and regulating nuclear power market competition, establishing civil liability for nuclear damage, in order to guarantee the safety of e
