Its purpose is to uncover the truth about an incident, and thus the investigation must be independent, objective, scientific and transparent. In addition, the independence of the investigative body must be fully recognized under the law, and the investigative body must be composed of professionals. The investigation procedures need to be scientific and rigorous, and the investigation process and the conclusions of the investigation should be made public. This paper uses the 7.23 accident investigation as a case study. Through a comparative analysis, the paper reveals existing flaws in the process of incident investigation in China, including a lack of independent administrative investigative bodies, a lack of legal recognition of the independence of investigative bodies, outdated investigation procedures, failure to uphold the publics right to a transparent investigation, and failure to consider prevention of future accidents during investigations.
