广东财经大学 2014-JX16- 本科毕业论文（设计） 论缺陷产品的法律责任 院 （系） 法学院 专 业 法学 班 级 法学四班 学 号 学生姓名 指导教师 提交日期 2014年4月23 日 摘 要 进入21世纪，随着改革发展的深入和市场经济的繁荣，各类产品也极大丰富起来。但伴随而来的因产品缺陷而引发的纠纷也越来越多，产品致害问题越发严重，这就使得人们逐步关注起有关缺陷产品的法律责任问题.我国一直没有制定专门的产品责任法，《民法通则》、《侵权责任法》、《产品质量法》、《消费者权益保护法》等法律中的相关规定共同构成了我国实质意义上的产品责任法。从立法和司法实践上看，我国的产品责任立法基本反映了国情，也合乎世界产品责任法的发展潮流。然而，其所存在不足之处，日渐影响了其功能的发挥。本文主要从《产品质量法》以及最新修订的《消费者权益保护法》的有关规定来研究缺陷产品的法律责任以及相关问题。 关键词：缺陷产品 召回 惩罚性赔偿 Abstract Enter in twenty-first Century , with the deepening of reform and development and the prosperity of market economy, all kinds of products are also greatly enriched. Accompanied by caused by product defect disputes more and more, product damage problems become more and more serious, which makes people gradually pay attention to the legal liability of the defective products. Our country has not make special product liability law, the general principles of the civil law, invasion, product responsibility law quality law, consumer protection law the relevant provisions of the law in our country consists of the essence of the product liability law. From the legislative and judicial practice, Chinas product liability legislation reflects the fundamental national condition, also conforms with the world trend of development of product liability law. However, its shortcomings, has affected the full play of its function. This paper mainly from the legal responsibility of the relevant provisions of the product quality law and the newly revised consumer protection law to study the defects of products and related problems.
